- General
(a) SonarAxe Australia is the promoter of this competition.
(b) Information on how to enter forms part of these Terms and Conditions.
(c) By entering any competition promoted by SonarAxe Australia, you agree to these Terms and Conditions and any other applicable terms as advised by SonarAxe Australia
- Entry requirements
(a) Entrants must be residents of Australia and 18 years of age or older and be able to attend the event.
(b) The employees, agents and contractors of SonarAxe Australia, any of its affiliate, parent or subsidiary companies or any agency associated with this competition are not eligible to enter the Competition.
(c) Direct family members of any person included in 2(b) are not eligible to enter.
(d) The competition can be entered online via the website https://www.thetranceproject.com.au
(e) To enter entrants must answer the following question in twenty-five words or less: “In 25 words or less, tell us what artist on the Green stage at Defqon 1 Australia this year, you would love to meet and why?”
(f) All entries must include full contact details: first name, last name, contact phone number, postcode, verification of being over 18 years old and contactable email address.
(g) Any person who fails to provide the full information in the manner requested as part of the entry process will not be eligible for any competition prize.
(h) Any information, photographs, audio-visual or other material provided to SonarAxe Australia, by an entrant as part on an entry to this competition, will not be returned to entrants. Entrants are advised to not send original material.
(i) Entries to this competition open when the competition is posted online on thetranceproject.com.au website and close at 11.59pm on 30th August 2015 (AEST). Entries received after closing time and date will not be eligible.
(j) SonarAxe Australia accepts no responsibility for lost entries.
(k) Unless otherwise agreed, any personal or confidential information submitted to TheTranceProject.com.au or to SonarAxe Australia by any person in the course of entering or being otherwise, involved in this competition such as name, address, telephone number will be treated in accordance with SonarAxe Australia’s Privacy Policy.
- Judging
(a) Entries will be judged at the Q-Dance Australia office at Suite 466, 311-315 Castlereagh St, Sydney NSW 2000.
(b) This Competition is a game of skill and all winners will be selected by appropriately qualified judges on the quality and creativity of their entries.
(c) The winner of the competition will be decided on Tuesday 1st September 2015, at the Q-Dance Australia office at Suite 466, 311-315 Pitt St, Sydney NSW 2000.
(d) Prize winners will be notified by 6pm on Wednesday, 2nd September 2015.
(e) Prize winners will be notified by email and telephone at the details provided in the entry. All reasonable efforts will be made to contact all prize winners.
(f) If SonarAxe Australia is unable to contact a prize-winner after reasonable efforts, SonarAxe Australia may award the prize to the next most creative entrant.
(g) The decision of the judges is final and SonarAxe Australia will not enter into correspondence or communication regarding the judges’ decisions even where SonarAxe Australia may not have acted reasonably or where SonarAxe Australia is shown to have made a decision in error.
- Prizes
a) Prizes constitute the following only:
- Two Saturday festival tickets to Defqon.1 Australia Festival 2015 (value $340)
- A chance to meet all the international Green stage artists backstage on the day (no value)
- A Defqon 1 Australia merchandise pack signed by all the Green stage artists at this year’s Defqon 1 Australia festival (no value)
Total prize pool value of prizes is $340.00
Prize does not include transport, accommodation or flights. Any additional costs in attending the festival or receiving this prize are to be beared by winner.
(b) SonarAxe Australia may require any person collecting or receiving a prize to show photograph identification and/or sign a deed declaring that they have collected or received the prize before SonarAxe Australia gives the prize over.
(c) SonarAxe Australia may require any person collecting a prize to sign a copy of these Terms and Conditions.
(d) Once a prize has been collected, SonarAxe Australia is not responsible for the use or distribution of any prize.
(e) SonarAxe Australia will not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for personal injury suffered or sustained, as a result of taking any prize under this competition.
(f) Where tickets to an Event are unavailable, the prize winner may be offered tickets to an alternative SonarAxe Australia event.
(g) The venue where the Event is being held may impose its own conditions and may refuse entry in its own discretion. SonarAxe Australia is not responsible for any refusal of entry made by the Venue.
(h) Where all or part of the Event is cancelled, rescheduled or varied for any reason, the Promoter may, at its own discretion, offer the prize winner tickets to an alternative event, subject to clause 4 (f).
(i) Where the Event is one at which alcohol will be served the prize winner and their guests must be aged 18 years or over. Minors may not permitted to attend the Event. All prize winners and their guests must carry valid photo identification with them at all times during the Event.
(j) If a prize referred to in this competition becomes unavailable for any reason, SonarAxe Australia reserves the right to substitute that prize for a similar item of similar value.
(k) Prizes are not transferable or redeemable for cash. SonarAxe Australia accepts no responsibility for any variation in the value of the prizes.
(l) Prize winners agree to participate in any promotional activity promoting SonarAxe Australia, prize sponsors and/or the competition at the reasonable request of SonarAxe Australia.
- Intellectual Property
(a) SonarAxe Australia may record, reproduce, publish, adapt, communicate or otherwise use the entrants’ and/or prize winners’ performances, names, voices, and likeness for the purposes of creating or producing any television program or other audio and/or audio-visual material and for advertising and publicity purposes in any media in perpetuity without needing to provide additional compensation.
(b) Any material, including without limitation competition entries and images and/or audio-visual material included in competition entries, submitted or provided by a competition entrant, and/or prize winner in association with any competition will become the property of SonarAxe Australia. SonarAxe Australia along with other sponsors may reproduce, publish, adapt, communicate, cause to be seen and/or heard in public or otherwise use any such material throughout the world in perpetuity and without needing to provide additional compensation.
(c) SonarAxe Australia may require an entrant or prize-winner to execute any document necessary to give effect to 5 (a) and/or (b).
- Warranties
(a) Entrants warrant and represent to SonarAxe Australia that nothing in any entry to any competition infringes the rights, including copyright, of any third party and is not defamatory or obscene and does not breach any state or commonwealth law.
(b) Entrants indemnify SonarAxe Australia against any claim, loss or damages suffered by SonarAxe Australia as a direct or indirect consequence of a breach by the entrant of any warranty or representation contained in these Terms and Conditions.
(c) If SonarAxe Australia becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to SonarAxe Australia, SonarAxe Australia may deem that prize winner ineligible.
- Governing Law
These Terms and Conditions are to be construed according to the laws New South Wales, Australia and are subject to the non-exclusive jurisdiction of the courts of that state.
